Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the SafeRide IQ mobile application ("the App," "the Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App. These Terms constitute a binding legal agreement between you and SafeRide IQ LLC ("SafeRide IQ," "we," "us," "our"), a limited liability company.

2. Eligibility

You must be at least 18 years of age to use SafeRide IQ. In jurisdictions where the legal drinking age is higher (such as 21 in the United States), you must be of that age to use any features of the App related to alcohol consumption tracking or impairment assessment. By using the App, you represent and warrant that you meet these age requirements.

The App is not intended for use by anyone under the legal drinking age in their jurisdiction. We do not knowingly permit minors to use the App.

3. Nature of the Service

3.1 SafeRide IQ is an advisory wellness tool

SafeRide IQ provides on-device behavioral self-assessments designed to help adults make informed decisions about whether they may be impaired and should not drive or perform other activities requiring full mental and physical capacity. The App estimates blood alcohol concentration (BAC) using:

• Self-reported drink information that you enter
• The Widmark pharmacokinetic formula adjusted for your reported body weight, sex, and other factors
• Behavioral test performance metrics from on-device assessments (eye tracking, balance, speech, and finger coordination)

3.2 SafeRide IQ is NOT a medical device

SafeRide IQ is not:

• A medical device, breathalyzer, or evidentiary blood-alcohol testing instrument
• A diagnostic tool for any medical, neurological, or psychological condition
• Approved, endorsed, or certified by any government agency, law enforcement organization, medical body, regulatory authority, or testing standards organization (including the U.S. National Highway Traffic Safety Administration, the U.S. Food and Drug Administration, or any state Department of Motor Vehicles)
• A substitute for professional medical advice, diagnosis, or treatment
• Approved for use in legal proceedings, employment screening, court-ordered testing, or any other official capacity

3.3 Accuracy limitations

BAC estimates produced by SafeRide IQ are statistical approximations, not measurements. Individual results may vary significantly based on:

• Accuracy and completeness of self-reported drink information
• Individual metabolism, genetics, body composition, and overall health
• Food consumption, hydration, sleep, and timing
• Medications, supplements, illness, or other substances
• Environmental factors during testing (lighting, surface stability, ambient noise)
• Device sensor quality, calibration, and operating conditions
• User effort, technique, and adherence to test instructions

A "Not Impaired" result from SafeRide IQ does not mean you are sober, below any legal BAC limit, or safe to drive. An "Impairment Indicated" result does not constitute medical or legal evidence of intoxication.

4. Your Responsibilities

4.1 Do not rely on the App to determine fitness to drive

You agree that you will not rely on SafeRide IQ as the sole or primary basis for any decision to:

• Operate a motor vehicle, boat, aircraft, or any other vehicle
• Operate heavy machinery, firearms, or any equipment requiring full mental and physical capacity
• Engage in activities where impairment could result in injury to yourself or others
• Provide testimony or evidence in any legal, administrative, or regulatory proceeding

The only safe choice after drinking is not to drive. If you have consumed any amount of alcohol and are uncertain whether you are safe to drive, do not drive. Use a ride-share service, call a sober friend, take public transportation, or stay where you are.

4.2 Honest and accurate self-reporting

You agree to provide honest, accurate, and complete information when entering data into the App, including drink counts, drink types, timing, and personal profile information. Inaccurate self-reporting will produce inaccurate estimates. The App cannot detect or compensate for false input.

4.3 Lawful use

You agree to use the App only in accordance with applicable laws. You will not use the App to:

• Encourage or facilitate driving under the influence of alcohol or any other substance
• Defeat, evade, or circumvent any law enforcement or regulatory measure
• Harass, deceive, or harm any other person
• Reverse engineer, decompile, or attempt to extract source code from the App

5. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THAT THE BAC ESTIMATES OR IMPAIRMENT INDICATORS PRODUCED BY THE APP ARE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE. ALL TEST RESULTS ARE ESTIMATES ONLY AND SHOULD NOT BE RELIED UPON AS DETERMINATIVE OF ANY FACT, INCLUDING WHETHER YOU ARE LEGALLY OR MEDICALLY FIT TO DRIVE.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAFERIDE IQ LLC, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOST DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OF OR INABILITY TO USE THE APP
• ANY DECISION YOU MAKE BASED ON RESULTS PRODUCED BY THE APP, INCLUDING ANY DECISION TO DRIVE OR PERFORM ANY OTHER ACTIVITY
• ANY BAC ESTIMATE OR IMPAIRMENT INDICATOR PRODUCED BY THE APP, WHETHER ACCURATE OR INACCURATE
• ANY ERRORS, OMISSIONS, OR INACCURACIES IN THE APP'S CALCULATIONS OR DISPLAYS
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA ON YOUR DEVICE

You acknowledge and agree that you assume all risks associated with your use of the App and any decisions you make based on the App's output.

7. Indemnification

You agree to indemnify, defend, and hold harmless SafeRide IQ LLC and its officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your breach of these Terms
• Your violation of any law or the rights of any third party
• Any decision you make based on the App's output, including any decision to drive

8. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, software, and the design of the App, are the exclusive property of SafeRide IQ LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only, subject to these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any portion of the App.

9. Third-Party Services

The App may include links or integrations with third-party services (such as Uber, Lyft, Curb, Waymo, and Apple App Store). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, availability, accuracy, or practices of any third-party service.

10. Modifications to the App and Terms

We may modify, suspend, or discontinue any aspect of the App at any time without notice. We may also update these Terms from time to time. The "Last updated" date at the top of these Terms indicates when they were last revised. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. Termination

These Terms remain in effect while you use the App. You may terminate these Terms at any time by uninstalling the App from your device. We may terminate or suspend your access to the App at any time, without notice, for conduct we believe violates these Terms or is otherwise harmful.

Sections 5, 6, 7, 8, 12, 13, and 14 survive any termination of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution

Before filing any legal action, you agree to first contact us at support@saferideiq.com to attempt informal resolution. If we cannot resolve the dispute informally within 60 days, either party may pursue available legal remedies subject to Section 12.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SafeRide IQ LLC regarding your use of the App, and supersede any prior agreements or understandings.

16. Apple App Store Additional Terms

If you obtained the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and SafeRide IQ LLC, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
