Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the SafeRide IQ mobile application ("the App," "the Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App. These Terms constitute a binding legal agreement between you and SafeRide IQ LLC ("SafeRide IQ," "we," "us," "our"), a limited liability company.

2. Eligibility

You must be at least 18 years of age to use SafeRide IQ. By using the App, you represent and warrant that you meet this age requirement. The App is not intended for or directed at anyone under 18, and we do not knowingly permit minors to use it.

3. Nature of the Service

3.1 SafeRide IQ is a personal wellness tool

SafeRide IQ provides on-device self-checks designed to help you observe your own coordination and focus over time. A full session presents four short tasks — a visual-tracking task using the front camera, a balance and steadiness task using the device's motion sensors, a focus and recall task using speech recognition, and a hand-eye coordination task using the touchscreen. The App combines these into a single coordination score and lets you compare it against a personal baseline built from your own prior sessions.

3.2 What SafeRide IQ is NOT

SafeRide IQ is not:

• A medical device or a diagnostic tool for any medical, neurological, or psychological condition
• A measure of blood alcohol concentration, intoxication, drug use, or impairment of any kind
• A measure of your fitness or ability to drive, operate machinery, or perform any task
• Approved, endorsed, or certified by any government agency, law-enforcement organization, medical body, regulatory authority, or standards organization
• A substitute for professional medical advice, diagnosis, or treatment
• Valid or admissible for use in legal proceedings, employment screening, court-ordered testing, or any other official capacity

3.3 Accuracy limitations

The scores produced by SafeRide IQ are approximate indicators of task performance, not precise measurements. Individual results may vary significantly based on:

• Individual differences, health, fatigue, and practice
• Environmental factors during a task (lighting, surface stability, ambient noise)
• Device sensor quality, calibration, and operating conditions
• Your effort, technique, and adherence to task instructions

Your coordination score and baseline reflect only how you performed the in-app tasks. They do not indicate whether you are sober, impaired, healthy, or safe or able to perform any real-world activity.

4. Your Responsibilities

4.1 Do not rely on the App for safety or capability decisions

You agree that you will not rely on SafeRide IQ as a basis for any decision to:

• Operate a motor vehicle, boat, aircraft, or any other vehicle
• Operate heavy machinery, firearms, or any equipment requiring full mental and physical capacity
• Engage in any activity where reduced coordination or focus could result in injury to yourself or others
• Provide testimony or evidence in any legal, administrative, or regulatory proceeding

SafeRide IQ does not tell you whether it is safe to do any of these things. If you are ever uncertain about your ability to drive or operate equipment, do not do so, and use a ride-share service, call a trusted contact, take public transportation, or stay where you are.

4.2 Lawful use

You agree to use the App only in accordance with applicable laws. You will not use the App to:

• Harass, deceive, or harm any other person
• Misrepresent the App's results as a medical, legal, or evidentiary determination
• Reverse engineer, decompile, or attempt to extract source code from the App

5. Subscriptions and Payment

SafeRide IQ is offered as an auto-renewing subscription and/or other in-app purchases sold and processed through the Apple App Store. The following terms apply:

• Payment is charged to your Apple Account at confirmation of purchase.
• A subscription automatically renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings after purchase (Settings → [your name] → Subscriptions).
• Prices are shown in the App and may vary by region. We may change subscription prices; any change applies only to future billing periods.
• Refunds, where applicable, are handled by Apple in accordance with Apple's policies. We do not process payments and cannot issue refunds directly.

All billing is handled by Apple. SafeRide IQ does not receive, process, or store your payment card or Apple Account details.

6. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THAT THE SCORES OR RESULTS PRODUCED BY THE APP ARE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE. ALL RESULTS ARE APPROXIMATE INDICATORS OF IN-APP TASK PERFORMANCE AND SHOULD NOT BE RELIED UPON AS DETERMINATIVE OF ANY FACT, CONDITION, OR CAPABILITY.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAFERIDE IQ LLC, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOST DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OF OR INABILITY TO USE THE APP
• ANY DECISION YOU MAKE BASED ON RESULTS PRODUCED BY THE APP, INCLUDING ANY DECISION TO DRIVE OR PERFORM ANY OTHER ACTIVITY
• ANY SCORE OR RESULT PRODUCED BY THE APP, WHETHER ACCURATE OR INACCURATE
• ANY ERRORS, OMISSIONS, OR INACCURACIES IN THE APP'S CALCULATIONS OR DISPLAYS
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA ON YOUR DEVICE

You acknowledge and agree that you assume all risks associated with your use of the App and any decisions you make based on the App's output.

8. Indemnification

You agree to indemnify, defend, and hold harmless SafeRide IQ LLC and its officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your breach of these Terms
• Your violation of any law or the rights of any third party
• Any decision you make based on the App's output

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, software, and the design of the App, are the exclusive property of SafeRide IQ LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only, subject to these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any portion of the App.

10. Third-Party Services

The App may include links or integrations with third-party services (such as Uber, Lyft, Curb, Waymo, and the Apple App Store). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, availability, accuracy, or practices of any third-party service.

11. Modifications to the App and Terms

We may modify, suspend, or discontinue any aspect of the App at any time without notice. We may also update these Terms from time to time. The "Last updated" date at the top of these Terms indicates when they were last revised. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Termination

These Terms remain in effect while you use the App. You may terminate these Terms at any time by uninstalling the App from your device. We may terminate or suspend your access to the App at any time, without notice, for conduct we believe violates these Terms or is otherwise harmful.

Sections 6, 7, 8, 9, 13, 14, and 15 survive any termination of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

Before filing any legal action, you agree to first contact us at support@saferideiq.com to attempt informal resolution. If we cannot resolve the dispute informally within 60 days, either party may pursue available legal remedies subject to Section 13.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SafeRide IQ LLC regarding your use of the App, and supersede any prior agreements or understandings.

17. Apple App Store Additional Terms

If you obtained the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and SafeRide IQ LLC, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
